If an alleged criminal makes a deal with the D.A., can the presiding judge "throw-out" the agreement?

Let' say a man kidnaps a little girl and is holding her hostage. The DA agrees to give him immunity if he tells where the girl is. Can the judge finds the agreement disgusting and decides to send the alleged kidnaper to prison anyway...
